What happens during a drunk driving stop?

Being pulled over on suspicion of drunk driving is difficult, partially because some people don’t know what to expect. Learning a little about drunk driving stops isn’t going to take away the stress of the situation, but it may help you to feel a bit more prepared. 

Several things might occur in a drunk driving stop. Each of these is meant to help the police officer determine if you’re driving while under the influence of any substance, including drugs or alcohol. 

Initial interview

The initial interview usually occurs as soon as the traffic stop is initiated. The officer will speak to you and ask you questions, but you should remember that you have specific rights. During the interview, the officer will also surveil the scene, including looking for signs of alcohol consumption like open containers in the vehicle. 

Field sobriety test

The field sobriety test is a way for officers to gauge your impairment. Only three tests, the walk and turn, one leg stand and horizontal gaze nystagmus, are part of the standardized field sobriety test that’s endorsed by the National Highway Traffic Safety Administration. The standardized field sobriety test is the only set of tests that are admissible in court, and that’s only the case if they’re presented together. 

Alcohol screening

Alcohol screening is another possibility in a drunk driving stop. You may be asked to blow into a roadside breath testing machine, which is known as a preliminary alcohol screening device. The result of that test is informational, but not admissible in court. Stationary breath tests, urinalysis and blood tests are all options that are admissible in court. 

If an officer has probable cause that shows you’re impaired, they will arrest you. Starting work on your defense strategy as soon as possible is important, so it’s beneficial to work with someone familiar with these matters.
